Governing Documents Board Committee. Yesterday (1/14) the committee of the 3 TMVOA Board members, Jim Royer – Class A Residential, John Volponi – Class B Lodging and Jeff Proteau – Class D Mountain Special held their first meeting. John Volponi agreed to serve as committee Chairman.
As a reminder, at the Annual Members Meeting last month TMVOA announced it had received approximately 50 letters from members regarding the organization’s governance structure, assessments and voting eligibility (link to 1/14 agenda and representative letter of those received from members). Additionally, TMVOA received inquiry from the Town of Mountain Village regarding eligibility to vote in the 2020 TMVOA election given that they pay TMVOA assessments for several properties.
As a result, in a member communication (12/3/20) we announced that the TMVOA Board unanimously voted to extend the election close date to Feb 8, 2021 in order to provide additional time to research these matters. Furthermore, the Board agreed on the formation of this Committee to review TMVOA’s governing documents to ensure they are current with Colorado Common Interest Ownership Act (CCIOA), state and federal regulations.
At yesterday’s meeting, the committee agreed that it would recommend to the full TMVOA Board at its 1/19 meeting that TMVOA engage outside legal counsel that specializes in regulations related to these matters. The committee also emphasized that the process would include a review of assessments, voting eligibility and be pursued in a transparent manner that includes routine public meetings.
